أعلنت الهيئة العامة للعقار اليوم (الخميس)، عن دخول نظام تملّك غير السعوديين للعقار حيز النفاذ، وبدء تطبيق أحكامه ضمن منظومة التشريعات العقارية المنظِّمة للسوق العقاري في المملكة، وذلك ابتداءً من اليوم 3 شعبان 1447هـ الموافق 22 يناير 2026م.

وأوضحت «الهيئة» أن استقبال طلبات تملّك غير السعوديين يتم عبر البوابة الرقمية الرسمية «عقارات السعودية»، وتشمل الخدمة المقيمين داخل المملكة وغير المقيمين، إضافة إلى الشركات والكيانات غير السعودية، وفق ضوابط وإجراءات نظامية محددة.

وبيّنت أن رحلة المستفيد تختلف بحسب فئة التملّك؛ حيث يتمكّن المقيمون داخل المملكة من التقديم مباشرة عبر البوابة باستخدام رقم الإقامة، مع التحقق الآلي من استيفاء المتطلبات النظامية واستكمال الإجراءات إلكترونيًّا، فيما تبدأ رحلة غير المقيمين من خلال الممثليات والسفارات السعودية في الخارج لإصدار الهوية الرقمية، تمهيدًا لاستكمال طلب التملّك عبر البوابة، بينما تقوم الشركات والكيانات غير السعودية التي ليس لها وُجود في المملكة والراغبة في التملّك بالتسجيل كخطوة أولى لدى وزارة الاستثمار عبر منصة «استثمر في السعودية» وإصدار الرقم الموحد (700)، قبل استكمال إجراءات التملّك إلكترونيًّا.

وأكدت «الهيئة» أن النظام يتيح لغير السعوديين من الأفراد والشركات والكيانات التملّك في مختلف مناطق المملكة العربية السعودية، ويحدد التملّك في مدن الرياض وجدة، وفي مكة المكرمة والمدينة المنورة، وفق إطار تنظيمي واضح يستند إلى وثيقة النطاقات الجغرافية التي سيُعلن عنها خلال الربع الأول من عام 2026م، مع مراعاة قصر التملك في المدينتين المقدستين على الشركات السعودية والأفراد المسلمين من داخل وخارج المملكة.

وأشارت «الهيئة» إلى أن بوابة «عقارات السعودية» تمثل المنصة الرقمية الرسمية المعتمدة لتطبيق نظام تملّك غير السعوديين للعقار، حيث تُمكّن الراغبين في التملّك من إتمام إجراءاتهم والتأكد من مطابقتهم للضوابط والاشتراطات المنصوص عليها نظامًا عبر رحلة مُيسرَّة ترتبط مباشرة بنظام التسجيل العيني للعقار، بما يسهم في تعزيز الشفافية وحفظ الحقوق.

وأضافت «الهيئة» أن النظام يهدف إلى رفع جودة المشاريع العقارية من خلال جذب المطورين الدوليين والشركات النوعية، وتحفيز النمو في القطاعات السكنية والتجارية والصناعية والسياحية، إلى جانب الإسهام في خلق فرص عمل واسعة للمواطنين في أنشطة عقارية ترتبط بالمشاريع العقارية والنمو العمراني، بما يعزز مساهمة القطاع العقاري في الناتج المحلي الإجمالي غير النفطي بشكل مستدام.

The General Authority for Real Estate announced today (Thursday) the implementation of the system for property ownership by non-Saudis, which will come into effect, starting today, 3 Sha'ban 1447 AH, corresponding to January 22, 2026 AD.

The Authority clarified that applications for property ownership by non-Saudis can be submitted through the official digital portal "Real Estate of Saudi Arabia," and the service includes residents inside the Kingdom and non-residents, in addition to non-Saudi companies and entities, according to specific regulatory controls and procedures.

It explained that the journey for beneficiaries differs based on the ownership category; residents within the Kingdom can apply directly through the portal using their residency number, with automatic verification of compliance with regulatory requirements and completion of procedures electronically. Meanwhile, the journey for non-residents begins through Saudi embassies and consulates abroad to issue a digital identity, in preparation for completing the ownership application through the portal. Non-Saudi companies and entities that do not have a presence in the Kingdom and wish to own property must register as a first step with the Ministry of Investment through the "Invest in Saudi Arabia" platform and obtain a unified number (700) before completing the ownership procedures electronically.

The Authority confirmed that the system allows non-Saudis, both individuals and companies, to own property in various regions of the Kingdom of Saudi Arabia, specifying ownership in the cities of Riyadh and Jeddah, as well as in Mecca and Medina, according to a clear regulatory framework based on the geographic scope document that will be announced during the first quarter of 2026, while ensuring that ownership in the two holy cities is limited to Saudi companies and Muslim individuals from within and outside the Kingdom.

The Authority pointed out that the "Real Estate of Saudi Arabia" portal represents the officially approved digital platform for implementing the system for property ownership by non-Saudis, enabling those interested in ownership to complete their procedures and ensure compliance with the regulatory controls and conditions through a streamlined journey directly linked to the land registration system, contributing to enhancing transparency and safeguarding rights.

Additionally, the Authority stated that the system aims to improve the quality of real estate projects by attracting international developers and quality companies, stimulating growth in residential, commercial, industrial, and tourism sectors, as well as contributing to creating extensive job opportunities for citizens in real estate activities related to real estate projects and urban growth, thereby enhancing the contribution of the real estate sector to the non-oil GDP sustainably.
